Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of Shavely ("Service"), a real-time multilingual translation chat application provided by B-Track Inc. ("Company", "we", "our", or "us"). By using the Service, you agree to be bound by these Terms.
2. Definitions
- "Service" refers to the Shavely web and mobile applications enabling real-time multilingual translation chat.
- "User" refers to any individual accessing or using the Service, including both Guest Users and Registered Users.
- "Ticket" refers to the virtual right required to create a chat room.
3. User Registration
- Users can register to become Registered Users, gaining access to full features including room creation and ticket purchasing.
- Guest Users can participate in chat rooms without registration but cannot create rooms.
- Guest Users can upgrade to Registered Users through the settings screen.
4. Service Features
The Service provides:
- Real-time multilingual translation chat
- Chat room creation and management (ticket-based)
- Ticket purchasing via Stripe
- Chat history downloads (Registered Users only)
- Participant management (Kick/BAN features)
5. Tickets and Plans
- Free tickets are distributed to Registered Users on the 1st of each month.
- Paid plans include:
- 1 Day Small: 5 participants, 24-hour validity
- 1 Day Large: 30 participants, 24-hour validity
- 1 Month Small: 5 participants, 1-month validity
- 1 Month Large: 30 participants, 1-month validity
- Users must manually select which ticket to use when creating rooms.
6. Payment and Billing
- Paid tickets are purchased via Stripe credit card payment.
- Mobile app purchases redirect to web browser for payment.
- All purchases are final and non-refundable.
7. Data Retention
- Chat rooms have expiration periods based on the plan (1 hour to 1 month).
- After expiration, rooms enter a 90-day grace period (read-only).
- Data is archived for 365 days after the grace period.
- After archive period, data is permanently deleted with CSV backups stored externally.
8. User Responsibilities
- Users are responsible for their use of the Service.
- Providing false information may result in account suspension or deletion.
- Users must exercise judgment when viewing translated content and external links.
9. Prohibited Activities
The following are prohibited:
- Illegal activities or violations of public order
- Harassment, discrimination, or spam
- Unauthorized access or system attacks
- Automated tools for mass access or scraping
- Fraudulent ticket acquisition
- Multiple account creation by the same person
- Intellectual property infringement
10. Content Moderation
We may restrict or remove content that:
- Violates laws or public order
- Contains harassment, discrimination, or offensive material
- Includes spam or advertising
- We reasonably determine to be inappropriate
We are not liable for any damages resulting from content moderation actions.
11. Account Termination
- We may suspend or delete accounts for Terms violations.
- Users may delete their accounts through the settings screen.
12. Disclaimers
- The Service may be modified, interrupted, or terminated without notice.
- Translation accuracy is not guaranteed.
- We are not liable for damages from communication failures or service interruptions.
13. Changes to Terms
We may modify these Terms at any time. Continued use after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of Japan. Disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
